Description of Service
CARIBBEAN FRONT DESK LIMITED is a travel and tourism service agency specializing in wellness travel for destinations within the Caribbean and outside the countries of Canada and the continental United States. In this role, we research and gather publicly available information and provide this information to you for your personal use in making a more informed decision about your wellness excursions.
CARIBBEAN FRONT DESK LIMITED case managers are not medical professionals and will not advise on any issues relating to medical treatment.
We facilitate contact with, and provide information about wellness excursions within and outside of Jamaica.
Through our network of travel and tourism affiliates within the caribbean our in-depth research we provide information about available wellness procedures/excursions and travel packages to assist you in making an informed decision. You agree to assume all responsibility in connection with choosing any excursion. We assume no responsibility or liability for any treatment or other services rendered by any facility or agency or for any malpractice claims and other claims that may arise directly or indirectly from any such advice, treatment or other services.
No Unlawful or Prohibited Use
As a condition of your use of our Services, you will not use our Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use our Services in any manner that could damage, disable, overburden, or impair any CARIBBEAN FRONT DESK LIMITED In. server, or the network(s) connected to any CARIBBEAN FRONT DESK LIMITED server, or interfere with any other party’s use and enjoyment of any Services. You agree to indemnify and hold Caribbean Front Desk Limited., its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party due to or arising out of your use of or conduct on the Caribbean Front Desk Limited Sites/Services. Caribbean Front Desk Limited reserves the right to disclose any personal information about you or your use of the Caribbean Front Desk Limited Sites/Services, including its contents, without your prior permission if Caribbean Front Desk Limited has a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of Caribbean Front Desk Limited or its affiliated companies; (3) enforce the terms or use; or (4) act to protect the interests of its members or others.
Caribbean Front Desk Limited’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Caribbean Front Desk Limited’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Caribbean Front Desk Limited Sites/Services or information provided to or gathered by Caribbean Front Desk Limited with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Caribbean Front Desk Limited assumes no responsibility regarding the accuracy of the information that is provided by Caribbean Front Desk Limited and use of such information is at the recipient’s own risk. Caribbean Front Desk Limited provides no assurances that any reported problems may be resolved with the use of any information that Caribbean Front Desk Limited provides. By furnishing information, Caribbean Front Desk Limited does not grant any licenses to any copyrights, patents or any other intellectual property rights. If any part of this agreement is determined to be unenforceable by a court of competent jurisdiction, the unenforceable portion will be modified by the court solely to the extent necessary to cause such portion to be enforceable, and the remainder of the agreement shall continue in full force and effect.
This agreement constitutes the entire agreement between you and Caribbean Front Desk Limited with respect to the use of this web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you Caribbean Front Desk Limited with respect to this web site. Venue
You agree that this User Agreement shall be governed by and construed in accordance with the law of Jamaica. We agree that any legal action or proceeding under or with respect to this agreement may be brought in the courts of the Jamaica; and for the purpose of any such legal action or proceeding, you hereby submit to the jurisdiction of such courts. You hereby agree not to raise and waive any objection to or any defence based upon the venue of such courts and any objection or defence based upon an inconvenient form. You also agree not to bring any legal action or proceeding under or with respect to this agreement outside Jamaica unless, for some reason, the courts of Jamaican courts do not have jurisdiction in the matter.
Arbitration
Except as otherwise expressly provided in this User Agreement, any dispute or claim arising under or with respect to this User Agreement will be resolved by arbitration under the provisions of the Jamaica Arbitration Act. The arbitrator in any proceeding may award reasonable costs and expenses, including reasonable attorneys’ fee, to the prevailing party.
